A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §25-1-9, relating to venue for civil and criminal actions at the Salem Correctional Center.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §25-1-9, to read as follows:

ARTICLE 1. ORGANIZATION AND INSTITUTIONS AND CORRECTIONS MANAGEMENT.

§25-1-9. Venue for Salem Correctional Center.


Notwithstanding any other provision of law, venue for any criminal or civil actions arising on the grounds and building of the Salem Correctional Center, established in the article, lies in the circuit or magistrate courts of Harrison County.

 

NOTE: The purpose of this bill is to clarify that because Salem Correctional Center lies in two counties, and the Courts of both Counties have expressed concern regarding venue, that venue shall lie in Harrison County for all actions.
